1. Scope and Provider

1.1 These Terms of Service (ToS) apply to the use of the web app "Transvoice" (hereinafter "App") and all associated services, particularly voice training functionalities, support and community areas (e.g. Discord server). The app is provided worldwide.

1.2 Provider and contractual partner for all services related to the app is:

1.3 Deviating or supplementary terms and conditions of the user are not recognized, unless the provider expressly agrees to their validity in writing.

1.4 These ToS apply to consumers as well as companies. If individual provisions are specifically designed for consumers or companies, this will be indicated.


2. Service Description

2.1 The app offers a voice training service for MTF (Male-to-Female) gender transition, where users can have their voice processed in real-time or save and analyze voice recordings. The goal is to change or train the voice.

2.2 In addition to the core function of voice processing, the app provides functions for:

  • Community interactions (e.g. via a Discord server),
  • Newsletter delivery (if subscribed by the user),
  • Support (contact via email or in-app function),
  • possibly other services (extensions, beta features).

2.3 The app is initially in a beta phase and is currently provided free of charge. In the future, a paid subscription model will be introduced (details see section 5).

2.4 There is no claim to a specific functionality or constant availability of the app. The provider reserves the right to change or discontinue content, functions and designs of the app, provided this is reasonable for users or based on legal requirements.

2.5 No medical advice: The services offered do not replace medical diagnosis, treatment or therapy. In case of health problems or questions, you should consult a specialist.


3. Registration and Contract Conclusion

3.1 To use the app's services, users must register. Registration takes place on the website by filling out the registration form and clicking the "Register" button. At the same time, the present ToS must be agreed to by activating the corresponding checkbox.

3.2 Upon completion of registration, a usage contract is concluded between the provider and the user, which is governed by these ToS.

3.3 Use of the app requires that you are at least 16 years old (or can act according to the age regulations applicable in your country). There is no age restriction in the sense of "18 years and older".

3.4 The provider reserves the right to reject registrations without giving reasons, especially in case of violations of the ToS or abusive use.


4. Use of the App and Usage Rights

4.1 Scope of use: The provider grants the registered user a simple, non-transferable and revocable right to use the app and its contents for their own private use. Further use (e.g. reproduction, commercial use, reverse engineering) is not permitted, unless expressly agreed or legally permitted.

4.2 Self-responsibility: The user is responsible for all content uploaded or published by them in the app or on the Discord server (e.g. audio files of their own voice). Uploading foreign voice recordings (from third parties) is not permitted.

4.3 Inadmissible content: It is forbidden to upload, distribute or make publicly accessible content that is illegal, pornographic, hateful, offensive or otherwise violates legal regulations, third-party rights or good morals.

4.4 Community rules: Special community guidelines apply to the Discord server or other community platforms (e.g. for respectful interaction). Violation of these rules may result in blocking or deletion of the user account.


5. Prices, Payment Terms and Subscription

5.1 Current beta phase: Use of the app is currently free (beta version status).

5.2 Future subscription model: The provider plans to introduce a monthly subscription. Details on price, scope of services and payment terms will be announced in due time and supplemented in these ToS or on the website. When the subscription model is introduced, users can decide whether they want to use the paid offer.

5.3 Payment service providers: For paid offers, the provider uses services from PayPal and Stripe. Payment processing is carried out in accordance with the terms of use of these third-party providers.

5.4 Cancellation: The subscription can be cancelled daily. The cancellation becomes effective at the end of the already paid month, so there is no automatic renewal for the following month. In case of automatic renewal, a new payment period begins each time, unless timely cancellation has been made.

5.5 Right of withdrawal: Within 14 days after payment, consumers have the right to withdraw their order without giving reasons and may receive a retroactive refund for the already paid month. A short message to lea@transvoiceapp.com is sufficient. Further information on the right of withdrawal can be found in the separate withdrawal instruction.


6. User Obligations

6.1 Truthful information: The user is obliged to provide correct and complete information during registration, especially regarding email address. Changes must be reported immediately.

6.2 Prohibition of sharing access data: The user must keep their access data (password, login) secure and may not pass them on to third parties.

6.3 Refraining from illegal actions: The user undertakes not to violate third-party rights through their behavior and not to take harmful actions (e.g. distribution of harmful software).

6.4 No medical claims: The user acknowledges that the use of the app has a purely supportive function for voice training and does not constitute medical advice. In case of health concerns, it is recommended to seek professional help.


7. Liability and Disclaimer

7.1 Principle: The provider is liable without limitation for intent and gross negligence as well as in case of injury to life, body or health. In case of slight negligent violation of an essential contractual obligation (cardinal obligation), liability is limited to the foreseeable, contract-typical damage at the time of contract conclusion. A cardinal obligation is an obligation whose fulfillment first enables the proper execution of the contract and on whose compliance the user can regularly rely.

7.2 Disclaimer for incorrect use: The provider is not liable for damages that are based on improper, unauthorized or inadmissible use of the app. If users make technical modifications, upload prohibited content or use the app in health-risk scenarios, this is done at their own responsibility.

7.3 No responsibility for medical results: Since this is not a medical product, the provider does not guarantee that voice training will lead to a desired medical or therapeutic result.


8. Duration and Termination

8.1 Free usage contract: The usage contract runs for an indefinite period and can be terminated by both parties at any time without observing a notice period, as long as no paid membership exists.

8.2 Subscription contract: As soon as a paid subscription model has been introduced and booked by the user, the termination regulation described in section 5 applies.

8.3 Termination for important reasons: The right to extraordinary termination for important reasons remains unaffected. An important reason exists in particular in case of:

  • Serious violations of these ToS or community guidelines
  • Illegal actions of the user in connection with the app

8.4 Form of termination: The termination can be declared in writing (email is sufficient) to lea@transvoiceapp.com.


9. Discord Community Rules

9.1 The use of the Discord community (or comparable platforms) is a voluntary additional service. Respectful interaction applies, discrimination, hate speech and bullying are prohibited.

9.2 In case of violations (e.g. insults, spam, illegal content), the provider can block or delete the corresponding account without prior notice. This house right serves to protect all participants.

9.3 The provider assumes no responsibility for content created or shared by users on the Discord server. However, if illegal content becomes known, it will be removed immediately.


10. Data Protection

For information on the handling of personal data, the provider refers to the privacy policy, which can be viewed in its current version on the website and/or in the app.


11. Right of Withdrawal for Consumers

11.1 Consumers within the meaning of § 13 BGB have a 14-day right of withdrawal. For contracts for digital content that are not delivered on a physical data carrier, the right of withdrawal may be restricted if the user has expressly agreed that execution of the contract begins before the withdrawal period expires (Art. 16 lit. m EU Consumer Rights Directive). Nevertheless, the provider grants a 14-day right of withdrawal from the payment date (see section 5.5).

11.2 Details on this are regulated in the separate withdrawal instruction, which is provided to the user when the contract is concluded.


12. Final Provisions

12.1 Applicable law: The law of the Federal Republic of Germany applies, excluding the UN Sales Law (CISG). This choice of law only applies to consumers insofar as they are not deprived of the protection granted to them by mandatory provisions of the country in which they have their habitual residence.

12.2 Jurisdiction: If the user is a merchant, legal person under public law or public-law special fund or if the user has no general jurisdiction in Germany, the jurisdiction for all disputes is at the provider's seat. The statutory regulation applies to consumers.

12.3 Contract language: The contract language is German. The provider may additionally provide English or other language versions without this creating a claim to use these languages.

12.4 Amendment of the ToS: The provider reserves the right to change these ToS with effect for the future, insofar as this is necessary for compelling reasons (e.g. change in the legal situation, expansion of app functions) and users are not unreasonably disadvantaged. The provider will inform about changes in due time. If a user does not object to the changes within a reasonable period, the changes are deemed approved.

12.5 Salvatorian clause: Should individual provisions of these ToS be wholly or partially invalid, the validity of the remaining provisions remains unaffected. In place of the invalid provision, the statutory regulation or a provision that comes as close as possible to the purpose pursued with the invalid provision applies.
